Terms of Service | Propcott

1) Who we are

Propcott ("Propcott," "we," "us," "our") is a platform for coordinated consumer action. Users organize and join campaigns ("Propcotts"), post updates, comments, and media, and participate in communities and live chat.

2) Agreement to these Terms

By accessing or using Propcott (the "Service"), you agree to these Terms of Service and our Privacy Policy. If you don't agree, do not use the Service.

3) Eligibility & Accounts

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service.
You're responsible for your account, credentials, and all activity under it.
Provide accurate information and keep it updated. We may suspend or terminate accounts that violate these Terms.

4) Platform Nature; No Guarantees

Propcott is a coordination and publishing platform. We do not guarantee any specific outcome, change, or result from campaigns, pledges, or discussions. Estimated impact metrics are directional, not audited, and are not financial advice.

5) User Content & Conduct

You are responsible for all content you post (text, images, links, polls, chat messages, etc.). You agree not to:

Violate laws or rights (including IP, publicity, privacy, or contractual rights)
Post deceptive, defamatory, hateful, harassing, or dangerous content
Incite violence or unlawful activity
Post private or confidential information without consent
Upload malware or attempt to disrupt the Service
Impersonate others or misrepresent affiliation

We may remove content or suspend accounts at our discretion to protect users and the platform.

6) Campaigns, Pledges, and Communities

Campaign creators control their campaign content. Creators may post updates and set goals, but outcomes are not guaranteed.
Joining/pledging is voluntary and may have personal, social, or economic implications; you accept all risks.
Communities are moderated by owners/moderators; they may set rules and remove content consistent with these Terms.

7) Intellectual Property; Licenses

Your content: You retain ownership. You grant Propcott a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your content as necessary to operate and improve the Service (including backups, caches, and derivative formats). This license ends when you delete content from the Service, except where copies persist in backups, logs, or where others have copied/shared your content.

Propcott IP: All platform software, design, and trademarks are owned by Propcott or its licensors. You may not copy, modify, distribute, reverse engineer, or create derivative works except as allowed by law.

8) Third-Party Links & Services

The Service may link to third-party websites or services. We aren't responsible for their content, policies, or practices.

9) Safety, Moderation, and Enforcement

We may remove content, restrict features, or terminate/suspend accounts if we believe there's a violation of these Terms, a legal requirement, or a risk to users. We may also preserve information if we receive lawful requests.

10) Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ESTIMATED IMPACT FIGURES ARE DIRECTIONAL ESTIMATES ONLY.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROPCOTT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) $100 USD OR (B) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

12) Indemnification

You agree to defend, indemnify, and hold harmless Propcott and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your content, or your violation of these Terms or applicable law.

13) Termination

You may stop using the Service at any time. We may suspend or terminate your access for any reason, including violations of these Terms. Sections that by their nature should survive termination (e.g., IP, Disclaimers, Limitation of Liability, Indemnification, Governing Law) will survive.

14) Changes to the Service or Terms

We may modify the Service and these Terms at any time. Material changes will be posted with a new "Last updated" date. Continued use after changes means you accept the revised Terms.

15) Governing Law & Dispute Resolution

These Terms are governed by the laws of [State/Country], without regard to conflicts principles.

Optional (consult counsel): Any disputes will be resolved by binding arbitration in [City, State/Country], on an individual basis (no class actions). You and Propcott waive jury trial rights.
